Terms of Service — HeatZone

1. The agreement

These terms are a contract between you and Zero Jump Apps LLC (“we”, “us”), the publisher of the HeatZone app for Android (“HeatZone”, “the app”). By installing or using HeatZone you accept them. If you do not accept them, do not use the app.

How we handle data is set out separately in the privacy policy, at https://zerojumpapps.com/legal/heatzone/privacy/. It is part of how the app works and you should read it, but it is a description of what we do rather than a set of obligations on you.

2. Who may use HeatZone

You must be at least 13 years old. If you are under the age at which you can enter a binding contract where you live, you may use HeatZone only with the agreement of a parent or guardian, who accepts these terms on your behalf.

You may not use HeatZone if the law where you are forbids it.

There is no account to create. The app identifies your copy with an anonymous id so that its limits can work (section 4); the privacy policy explains what that id is and is not.

3. What we give you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install HeatZone on Android devices you own or control and to use it for your own, non-commercial purposes, in line with these terms and with Google Play’s terms of service.

HeatZone is free to use, and every feature is free. It is supported by advertising (section 8). There is one optional purchase, “Remove ads”, which takes the advertising away and changes nothing else.

Everything in the app that is not yours or a third party’s, including its name, logo, design and code, belongs to Zero Jump Apps LLC. These terms give you a licence to use the app, not ownership of any part of it.

4. Pins

A pin is a statement that someone is playing a particular sport at a particular place for the next 30, 60 or 120 minutes. When you drop one:

  • You are telling everyone who opens the map that people are playing there now. Drop a pin only where you actually are, for the sport actually being played.
  • It is anonymous. It carries no name and nothing that links it to you or to your other pins, and nobody using the app can find out who placed it.
  • Its position is rounded to a 25-metre grid before it leaves your phone.
  • It can be extended once, to a limit of three hours in total, and then it is deleted. You can remove it yourself at any time before that from the My pin tab.
  • You can have one live pin at a time and create at most ten in any hour.

You give us permission to store your pin, to show it to other users on the map, and to count it in the aggregated heat the map displays, for as long as it exists. That permission ends when the pin is deleted. Because pins are anonymous and short-lived, we ask for nothing beyond that.

Your ability to remove or extend a pin is held only on your device. If you clear the app’s data, reinstall it or change phones, you lose control of any pin still live; it will still expire on its own. We cannot restore that control, because there is no account to restore it to.

5. What you may not do

You agree not to:

  • place pins that are false, misleading or not about sport being played: invented activity, the wrong sport, a place that is not a court, field, track or other venue, or a place you are not at;
  • place a pin on private property without the right to be there, or in order to draw people to a private home, a school during school hours, or anywhere they are not permitted;
  • use pins, reports or anything else in the app to harass, stalk, threaten, endanger or locate any person;
  • use HeatZone to advertise, promote a business or event, or send any kind of message. A pin says “people are playing here” and nothing else;
  • abuse reporting, including reporting pins you know to be genuine or coordinating reports to hide them;
  • get around the app’s limits, including the one-pin cap, the rate limits, location checks and app attestation, whether by modifying the app, spoofing your location, running it in an automated or emulated environment, or calling our servers from anything other than an unmodified copy of the app;
  • scrape, harvest or bulk-download pins, heat data or venue data, or build a history of activity from them;
  • probe, disrupt or overload the service, or attempt to read data the app does not show you;
  • reverse engineer, decompile or redistribute the app, except where the law gives you a right to that we cannot exclude;
  • use HeatZone for anything unlawful.

6. Reports and moderation

Any pin can be reported as fake, the wrong sport, not a venue, or for another reason. A pin reported by three different people is hidden automatically. Reports are anonymous to other users.

We may remove or hide any pin, and we may limit or block access from any device or anonymous id, without notice, where we believe these terms have been broken or the service or its users are at risk. We are not obliged to monitor the map and we do not review pins before they appear. There is no appeal process for a hidden pin: it would have expired within hours in any case.

7. What the map is, and is not

Please read this section carefully. It describes the limits of what HeatZone can tell you.

EVERYTHING ON THE MAP IS UNVERIFIED. Pins are placed by anonymous members of the public. We do not check that anyone is where a pin says, that the sport is right, that a game is open to newcomers, or that the people there are who you would want to meet. Heat is a count of those pins and inherits all of their uncertainty. An empty map means nobody has pinned, not that nobody is playing.

VENUES ARE NOT AN INVITATION. Courts and fields come from OpenStreetMap, a public map edited by volunteers. A venue being shown does not mean it exists, is open, is public, is free, is safe, or that you are allowed on it. Obey signs, opening hours, booking rules, property boundaries and the law. Do not trespass because a map had a pin on it.

YOUR SAFETY IS YOUR RESPONSIBILITY. Sport carries a risk of injury. Going somewhere to meet people you do not know carries its own risks. Use the judgement you would use anywhere else: go to public places, tell someone where you are going, and leave if something feels wrong. Parents and guardians are responsible for deciding whether and how a minor uses HeatZone. We do not organise, supervise, insure or take part in any activity shown on the map, and we are not responsible for the conduct of anyone you meet through it.

HEATZONE IS NOT AN EMERGENCY SERVICE and must not be relied on in one. It cannot summon help and nobody is watching the map on your behalf.

The map, your position on it and the distances shown depend on GPS, your device and your connection, and can be wrong.

8. Advertising and third-party services

HeatZone displays a banner advertisement supplied by Google AdMob. We do not choose or endorse the individual ads, and anything you do after tapping one is between you and the advertiser.

“Remove ads” is a one-time purchase, not a subscription. It removes the banner permanently for the Google account that bought it, on any Android device signed in to that account, including after you reinstall the app or use “Delete my data”. It unlocks no features, because there are none to unlock. The purchase is made through Google Play and is subject to Google Play’s terms; the price is the one Google Play shows you at the time, in your currency, and may differ between countries and change over time. Payment and refunds are handled by Google Play under its refund policy. If a purchase is refunded, the advertising returns. If we ever stop showing advertising altogether, the purchase will have nothing left to remove and no refund will be due for that reason alone.

The app relies on services provided by others, which have their own terms:

  • Google Maps. The map is provided by the Google Maps SDK for Android. By using HeatZone you are also bound by the Google Maps/Google Earth Additional Terms of Service and by the Google Privacy Policy.
  • Google Firebase, Google Play Integrity and Google AdMob, under Google’s terms and policies.
  • OpenStreetMap. Court and field locations are © OpenStreetMap contributors and are made available under the Open Database License (ODbL) 1.0. That licence, and not these terms, governs your use of that data.

We are not responsible for services we do not operate, and a fault in one of them may make all or part of HeatZone unavailable.

9. Availability and changes to the app

We may change, suspend or withdraw HeatZone, or any part of it, at any time. We aim to keep it running but do not promise that it will be available, uninterrupted, timely or free of errors, and we are not obliged to support or update it. Some features need a network connection, location permission or a recent version of Android or Google Play services.

10. Ending this agreement

You can stop at any time by uninstalling the app. Using “Delete my data” in Settings first removes your live pins and your anonymous id.

We may end or suspend your licence at any time if you break these terms. Sections 3 (ownership), 7, 11, 12, 13 and 15 continue to apply after the agreement ends.

11. No warranty

To the fullest extent the law allows, HeatZone is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. In particular we give no warranty about the accuracy or completeness of any pin, heat level, venue, position or distance shown.

Some jurisdictions do not allow certain warranties to be excluded. Where that is so, the exclusion applies only as far as the law permits, and any rights you have as a consumer that cannot be waived are unaffected.

12. Limit of our liability

To the fullest extent the law allows:

  • we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of data, profit, goodwill or opportunity;
  • we are not liable for personal injury, property damage or any other harm arising from your travelling to, being at or taking part in any activity at a place shown in the app, from the acts or omissions of any other user or any third party, or from your reliance on anything the map displayed;
  • our total liability to you for everything connected with HeatZone is limited to the greater of the amount you paid us for the app in the twelve months before the claim, which is nothing, and fifty US dollars (US$50).

These limits apply whatever the legal basis of the claim, and even if we had been told the loss was possible. Nothing in these terms limits liability that cannot lawfully be limited, which in many places includes liability for death or personal injury caused by negligence, for fraud, and for gross negligence or wilful misconduct.

13. Your responsibility to us

If someone brings a claim against us because of pins you placed, or because you broke these terms or the law while using HeatZone, you agree to compensate us for the reasonable losses and costs that result, including legal fees, to the extent the law allows and the claim is attributable to you.

14. Changes to these terms

We may update these terms. When we do, we will change the date at the top and, for a material change, note it in the app’s release notes. The updated terms apply from the date they are published. If you keep using HeatZone after that you accept them; if you do not agree, stop using the app.

15. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Puerto Rico and the applicable federal laws of the United States, without regard to conflict-of-law rules. Disputes will be heard by the courts located in Puerto Rico, and you and we accept their jurisdiction.

If you are a consumer living somewhere whose law gives you mandatory protections or the right to bring proceedings in your local courts, nothing in this section takes those away.

Please write to us first. Most problems are solved faster by an email than by a claim.

16. General

If any part of these terms is found to be unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these terms; we may transfer ours to a successor that takes over the app. These terms, with the privacy policy, are the whole agreement between you and us about HeatZone.

Google is not a party to these terms and is not responsible for the app or its content.
